Qianyuan User Agreement & Qianyuan Personal Information Protection Policy
The following content is the "Qianyuan User Agreement" and "Qianyuan Personal Information Protection Policy". Please read carefully and fully understand the relevant terms before registering for Qianyuan. The "Qianyuan User Agreement" includes acceptance of terms; service description; user account, password, and security; user personal information protection; provider's responsibility; service changes, interruptions, or termination; warranties and guarantees; user behavior; intellectual property; user exclusive rights; special notice for international use; general terms. The "Qianyuan Personal Information Protection Policy" includes how we collect and use your personal information; how we use cookies and similar technologies; how we share, transfer, and publicly disclose your personal information; how we protect your personal information; your rights; information about children's personal information; how your personal information is transferred globally; how this policy is updated; and how to contact us. Once you register for Qianyuan, it is deemed that you have understood and agreed to all the contents of the "Qianyuan User Agreement" and "Qianyuan Personal Information Protection Policy".
This agreement is a revised version of the Qianyuan "User Agreement", published on October 29, 2024.
Please read carefully and fully understand the relevant terms of the agreement, especially the content marked in bold. Once you register for Qianyuan, it is deemed that you have understood and fully agreed to all the contents of this agreement, including any modifications made by Qianyuan to the user agreement at any time. If you do not agree with this agreement and/or any modifications to it, please stop registering and using all the services provided by Qianyuan immediately.
1.1 The operator of the Qianyuan App and its related affiliated companies (hereinafter referred to as "Qianyuan") provide you with internet services based on the Qianyuan network (including Qianyuan PC, Qianyuan and related clients, mobile web, etc.) according to the terms of this user agreement and the rules published from time to time. The terms of this agreement may be modified by Qianyuan at any time, and the modified user agreement will be effective immediately upon publication on the website, replacing the original user agreement. Once you register on the Qianyuan network, you become a Qianyuan user (hereinafter referred to as "user" or "you") and are bound by this agreement.
1.2 When you use a single service of the Qianyuan App, you and Qianyuan should comply with the guidelines and rules related to the service published by Qianyuan from time to time. All the aforementioned guidelines and rules constitute part of this user agreement.
1.3 You should comply with all the terms of this agreement and use the services provided by Qianyuan legally and reasonably. Otherwise, Qianyuan has the right to interrupt or terminate the services provided to you according to this agreement. At the same time, Qianyuan reserves the right to reclaim the account you are using at any time.
2.1 Users understand and agree that Qianyuan's services, products, and materials are provided only as they are currently presented, and Qianyuan expressly disclaims any express or implied warranties or guarantees for "services", "materials", or "products", including but not limited to warranties or guarantees for commercial use, suitability for a particular purpose, or non-infringement of others' rights. Qianyuan is not responsible for any direct, indirect, incidental, or consequential losses caused by "services", "products", or "materials". Qianyuan is not responsible for any issues such as the timeliness, deletion, transmission errors, or failure to store any user information or personalized settings.
2.2 You agree that Qianyuan has the right to formulate general measures and restrictions on the use of this service, including but not limited to the maximum period for which the content published by this service or other published content will be retained, and the maximum number of times you use this service within a certain period (and/or the maximum duration of each use). You agree that Qianyuan is not responsible for any information, communication materials, and other content published or transmitted through this service being deleted or not stored. You also agree that Qianyuan has the right to change these general measures and restrictions at any time at its sole discretion, whether notified or not.
4.1 After the account is assigned through the operation management background, you can use the assigned account and password to log in to your account on the Qianyuan network (hereinafter referred to as "account"). Once the assignment is completed, you obtain the right to use the account. It is your responsibility to protect the security of the account.
4.2 You are fully responsible for all actions taken using your account. You agree:
1) You will immediately notify Qianyuan if your Qianyuan account is used without authorization or if any other security issues occur;
2) Qianyuan is not responsible for any loss or damage caused by your failure to keep your account and password secure;
3) You are fully responsible for any damage caused to you, Qianyuan, or a third party by all actions taken using the account, including your failure to keep your account or password secure.
4.3 Since the account can access the user's personal information, and the ownership of the account belongs to Qianyuan, unless explicitly stipulated by law, users may not transfer, sell, or lend the account to others without Qianyuan's consent.
4.4 If you do not log in to the Qianyuan platform for six consecutive months and there are no unexpired valid businesses, Qianyuan has the right to restrict your use of the account. You will bear any adverse consequences caused by this.
4.5 If you choose to bind your Qianyuan account with a third-party account, except for you voluntarily unbinding the relationship, if any of the following situations occur, the third-party account you have bound may also be unbound, and Qianyuan will not be responsible for you or any third party:
1) You violate laws, regulations, national policies, or this agreement;
2) You violate the user agreement or related regulations of the third-party account;
3) Other situations that require unbinding.
5.1 Protecting your personal information security is both a legal requirement and a basic principle that Qianyuan has long adhered to. Qianyuan will process your personal information in accordance with Chinese laws, this agreement, "Qianyuan Personal Information Protection Policy".
5.2 In general, you can browse and modify your information on Qianyuan at any time, but for security and identity recognition reasons, you may not be able to modify the initial registration information and other verification information provided at the time of registration.
**6.1 According to relevant laws and regulations, Qianyuan hereby solemnly reminds you that any text, music, pictures, graphics, videos, or other materials (hereinafter referred to as "content") uploaded through this service, whether publicly or privately transmitted, are the responsibility of the content provider.** Qianyuan only provides information storage space services for users and cannot control the content transmitted through this service, so it does not guarantee the correctness, completeness, or validity of the content. You have foreseen that when using this service, you may encounter unpleasant, inappropriate, or offensive content. In any case, Qianyuan is not responsible for any content, but Qianyuan has the right to stop transmitting any of the aforementioned content in accordance with the law and take corresponding actions, including but not limited to suspending the user's use of all or part of this service, saving relevant records, and reporting to relevant authorities.
6.2 You expressly understand and agree that Qianyuan is not responsible for any direct, indirect, incidental, special, consequential, or punitive damages caused by the following reasons, including but not limited to economic, reputation, data loss, or other intangible losses:
1) The use or inability to use this service;
2) The cost incurred for replacing any goods, data, information, services obtained from or through this service, received messages, or transactions concluded with third parties;
3) Unauthorized access to or alteration of your transmissions or data;
4) Any statements or actions made by third parties in this service;
5) Third parties publishing or delivering fraudulent information in any way, or inducing users to suffer economic losses;
6) Other matters related to this service, except as explicitly stipulated in this user agreement.
7.1 Qianyuan may change the content of the service, or may interrupt or terminate the service.
7.2 Given the particularity of network services (including but not limited to server stability issues, malicious network attacks, or situations beyond Qianyuan's control), you agree that Qianyuan has the right to interrupt or terminate part or all of the services at any time.
7.3 You understand that Qianyuan needs to regularly or irregularly suspend part or all of the services for maintenance, upgrades, or other purposes of the platform or related equipment that provides services. If the service is interrupted within a reasonable time due to such situations, Qianyuan does not need to bear any responsibility for this.
7.4 If any of the following situations occur, Qianyuan has the right to interrupt or terminate the services under this agreement to you at any time without bearing any responsibility to you or any third party:
1) You provide untrue personal information;
2) You violate laws, policies, or this user agreement.
7.5 You agree that Qianyuan, based on its sole discretion, for any reason, including but not limited to lack of use, or Qianyuan believes that you have violated this user agreement, terminate your account or the use of this service (or any part of the service), and remove and delete any content in this service. You agree that the services provided under this user agreement can be interrupted or terminated without prior notice. You acknowledge and agree that Qianyuan can immediately close or cancel your account and delete all related information and files in your account, and/or prohibit the continued use of the aforementioned files or this service. In addition, you agree that if the use of this service is interrupted or terminated or your account and related information and files are closed or canceled, Qianyuan will not bear any responsibility to you or any third party.
You expressly understand and agree:
1) Any provision of this user agreement will not exempt Qianyuan from any liability for personal injury or property damage caused to you due to fault;
2) Qianyuan does not guarantee the following:
· This service will meet your requirements;
· This service will be uninterrupted, timely, secure, reliable, or error-free;
· The results obtained from using this service are correct and reliable;
· Any products, services, information, or other information obtained through this service will meet your expectations;
3) Whether to download or obtain any materials through this service should be considered by you and at your own risk. Any consequences such as damage to your computer system or data loss caused by downloading any materials shall be borne by you;
4) Any advice or information obtained from Qianyuan or through this service, whether in written or oral form, will not constitute any guarantee outside of this user agreement unless explicitly stipulated in this user agreement.
9.1 You should comply with the relevant laws and regulations of the People's Republic of China and agree to bear full responsibility for any behavior and its results using this service in any way using your login account. If your behavior violates national laws, you will bear full legal responsibility according to the law; if it is suspected of constituting a crime, the judicial authorities will pursue your criminal responsibility, and Qianyuan will strictly cooperate according to the legal obligations and the requirements of the judicial authorities. At the same time, if Qianyuan has reason to believe that any of your behaviors, including but not limited to any of your statements or other behaviors, violate or may violate any provisions of national laws and regulations, Qianyuan may terminate the services provided to you at any time without any prior notice.
9.2 You agree not to use this service for any illegal or improper activities, including but not limited to the following behaviors:
1) Publish or otherwise transmit information containing any of the following contents:
· Opposing the basic principles established by the constitution;
· Endangering national security, leaking state secrets, subverting state power, undermining national unity;
· Damaging national honor and interests;
· Inciting ethnic hatred, ethnic discrimination, undermining national unity;
· Undermining national religious policies, promoting cults and feudal superstitions;
· Spreading rumors, disturbing social order, undermining social stability;
· Spreading obscenity, pornography, gambling, violence, murder, terror, or abetting crime;
· Insulting or slandering others, infringing on the legitimate rights of others;
· Containing false, fraudulent, harmful, threatening, infringing on others' privacy, harassing, infringing, defamatory, vulgar, obscene, or other morally objectionable content;
· Containing other content restricted or prohibited by Chinese laws, regulations, (departmental) rules, and any legally effective norms;
· Containing content that Qianyuan deems inappropriate to display on Qianyuan;
2) Endanger the legitimate rights and interests of others in any way;
3) Impersonate any person or institution, or falsely state or misrepresent your relationship with any person or institution;
4) Publish, send emails, or otherwise transmit any content that you have no right to transmit under any law, contract, or statutory relationship (such as internal information, proprietary and confidential information obtained or disclosed due to employment relationships and under confidentiality agreements);
5) Publish or otherwise transmit content that infringes on others' copyrights, patent rights, trademark rights, trade secrets, or other proprietary rights (hereinafter referred to as "proprietary rights");
6) Publish, send, or otherwise transmit any "advertising letters", "promotional materials", "spam", "chain letters", "direct sales", or other forms of solicitation materials;
7) Publish, send, or otherwise transmit any computer viruses (including but not limited to trojan horses, worms, time bombs, cancelbots) or other computer codes, files, and programs designed to interfere with, destroy, or limit the functionality of any computer software, hardware, or communication equipment;
8) Interfere with or disrupt this service or the servers and networks connected to this service, or violate any regulations, procedures, policies, or norms related to the networks connected to this service;
9) Stalk, search for personal information, or otherwise harass others;
10) Intentionally or unintentionally violate any applicable local, national laws, and any legally effective rules;
11) Intercept, tamper with, collect, store, or delete your or others' personal information, internal messages, or other data without legal authorization, or use such information for any illegal or improper purposes. You acknowledge that Qianyuan does not fully control users' behavior, and when you use any content, including relying on the correctness, completeness, or validity of the aforementioned content, you agree to make your own judgment and bear all risks without relying on Qianyuan. However, Qianyuan has the right to refuse and delete any content provided through this service that violates these terms or other content that Qianyuan finds objectionable at its sole discretion.
9.3 Due to any claims or requests made by any third party arising from or caused by the content you provide, publish, or transmit through this service, your connection to this service, your violation of this user agreement, or your infringement of others' rights, including but not limited to reasonable attorney fees and litigation costs, you agree to compensate Qianyuan and its subsidiaries, affiliates, senior officers, agents, brand co-owners, or other partners and employees, and hold them harmless, and bear all legal responsibilities arising from this.
9.4 You agree not to reproduce, copy, sell, resell, or use any part of this service or the use or acquisition of this service for any other commercial purposes.
10.1 The intellectual property rights of the content provided by Qianyuan in this service (including but not limited to web pages, interface design, layout framework, text, audio, video, pictures, or other materials) belong to Qianyuan or related rights holders. Unless otherwise agreed, the copyrights, patent rights, and other intellectual property rights of the software, systems, etc., relied on by Qianyuan to provide this service belong to Qianyuan. Qianyuan, Qianyuan, and other Qianyuan logos and product and service names are trademarks of Qianyuan. Without Qianyuan's prior written consent, you may not delete, cover, or change Qianyuan's copyright statement, trademark, or other rights statement, nor may you display, use, or otherwise process Qianyuan's trademarks in any way, or indicate that you have the right to display, use, or otherwise process Qianyuan's trademarks.
10.2 You should ensure that the content you upload or publish on Qianyuan is owned by its copyright owner or has obtained legal authorization, and that the content does not infringe on any third party's legitimate rights. By clicking to agree to this agreement, you agree to grant Qianyuan a non-exclusive license to use all the aforementioned content, under which Qianyuan will have the right to use the aforementioned content in ways not prohibited by Chinese law, such as display and promotion, and to attribute the aforementioned content to Qianyuan users for the purpose of protecting your personal information or privacy security. At the same time, you agree to authorize Qianyuan to protect your rights in any matter where any entity infringes on your rights, including but not limited to sending rights protection letters, filing lawsuits, applying for arbitration, etc., which will be effective for any content protected by copyright law published by users on Qianyuan. You can also authorize other third parties to protect your rights and can terminate the authorization to Qianyuan at any time.
10.3 You have the right to authorize others to use the content you publish on Qianyuan. Qianyuan welcomes you to choose Qianyuan to cooperate on related content first.
10.4 You understand and agree that this service and the related software used by this service contain proprietary confidential information protected by relevant intellectual property rights and other laws. You also understand and agree that the content contained in sponsored advertisements or information presented to you by advertisers through this service is also protected by copyright, trademark, patent, or other proprietary rights. Without the express authorization of Qianyuan or advertisers, you may not modify, rent, lend, sell, distribute any part or all of this service or software, or create derivative works based on it, or use unauthorized modified software, etc. Qianyuan only grants you a personal, non-transferable, and non-exclusive right to use its software for the purpose of using it on a single computer, but you may not (and may not allow any third party to) copy, modify, adapt, translate, create derivative works, reverse engineer, decompile, disseminate, or otherwise discover the source code, or sell, transfer, sublicense, or provide software as collateral, or otherwise transfer any rights to the software. You agree to use this service only through the interface provided by Qianyuan and not through any other means.
10.5 If you violate the World Copyright Convention, the Copyright Law of the People's Republic of China, the Trademark Law, the Patent Law, the Anti-Unfair Competition Law, and other laws and regulations related to intellectual property rights or the provisions of this agreement, you shall bear the damage caused to others (including Qianyuan) and bear the corresponding legal responsibilities.
11.1 Qianyuan respects the legitimate rights of others (including intellectual property rights, reputation rights, goodwill rights, etc.) and calls on you to respect the legitimate rights of others as well.
11.2 If you violate the prohibitive provisions of laws and regulations and infringe on the legitimate rights of others or public interests, Qianyuan will delete specific content or even terminate your use of the account in accordance with the provisions of national laws and regulations, or in appropriate circumstances, in accordance with this agreement or its related provisions.
11.3 If you believe that your legitimate rights have been infringed, please refer to the "Qianyuan Infringement Complaint Guide" and submit a complaint according to the guide's instructions. Qianyuan will handle it according to the law.
You have understood the borderless nature of the internet and agree to comply with all local laws and regulations regarding online behavior and content. You specifically agree to comply with all applicable laws and regulations regarding the transmission of information exported from China or the country or region where you are located.

2. Affiliated Company: Refers to a company that has an affiliated relationship with Beijing Douban Technology Co., Ltd. and is related to the products or services described in this policy, namely Beijing Qianyuan Interactive Technology Co., Ltd., Beijing Qianyuan Douban Culture Co., Ltd., Beijing Ark Reading Technology Co., Ltd., Tianjin Zhaowei Internet Technology Co., Ltd.

10. Device Identifier: Android device identifiers include Android ID, OAID, GUID, iOS device identifiers include IDFV, IDFA, GUID, HarmonyOS device identifiers include HarmonyOS OAID, GUID.
1. How We Collect and Use Your Personal Information
To achieve the business functions described in this policy, we will collect and use your personal information in the following ways. Except as otherwise provided by law, you have the right to refuse us to collect and use your personal information. However, please understand that if you refuse us to collect and use the personal information necessary for business functions, you may not be able to use the corresponding business functions.
(1) Account Login

When you log in to your Qianyuan account with your account password, we need to collect your mobile phone number or email address to create an account, verify login, and ensure account security. We may verify your account by sending a text message verification code or email.
(2) Safe Operation and Analysis Statistics
To meet the requirements of the "Cybersecurity Law of the People's Republic of China" (hereinafter referred to as the "Cybersecurity Law") and the needs of network security protection, to provide you with safe and reliable products and services, to detect potential security risks, to protect your account security, and to prevent your account from being stolen and your personal information from being illegally obtained, we need to collect your network information (IP address, WLAN list, Bluetooth, base station, access network method, type, status, network quality data, operator information), device information (device model, hardware configuration, operating system, system settings, user identification ID, OAID, GUID, IDFV, IDFA, software version number), and log information to judge your account risk, and to prevent, discover, and investigate behaviors that endanger system operation security, are illegal, or violate our rules and agreements. To ensure the stability and security of our products or services, and to better understand the overall operation of our products or services (such as usage frequency, crash situation, performance data), we will also collect your aforementioned network information, device information, and log information, and conduct data statistics and analysis. If you do not provide the above information, we will not be able to protect the security of products or services and your account and information during your use of our products or services.
(5) Exceptions to Obtaining Authorization and Consent
Please be fully aware that in the following situations, we do not need to obtain your consent to collect and use your personal information:
1. It is necessary to conclude or perform a contract to which you are a party, or to implement human resource management in accordance with labor rules and regulations formulated according to law and collective contracts signed according to law;

Cookies from Qianyuan can only be read by Qianyuan. If your browser is set to reject cookies, you can still access most of Qianyuan's web pages. (2) Web Beacons and Pixel Tags
In addition to cookies, we will also use other similar technologies such as web beacons and pixel tags on the website. 3. How We Provide Your Personal Information Externally

(2) Joint Processing
**1. Joint processing with affiliated companies.** Some business functions described in this policy are provided to you by Beijing Douban Technology Co., Ltd. and its affiliated companies as joint processors. We promise to only jointly process necessary personal information and be bound by the purposes stated in this policy.
**2. Joint processing with partners.** To achieve the purposes stated in this policy, some of our products or services will be jointly provided to you by us and our partners. We may jointly process some of your personal information with the following partners to provide better customer service and user experience.
(1) Cooperative third-party merchants: To help you achieve the purchase of products or services and provide you with after-sales service, and for the necessary financial settlement between us and our partners, we will jointly process your order and related transaction records, customer service communication records (online chat records, phone recordings, emails), recipient information (recipient name, delivery address, contact phone number).Related transaction records, customer service communication records are sensitive information, and refusing us and cooperative third-party merchants to jointly process this information may prevent you from achieving the purpose of the transaction function, but it will not affect your normal use of other functions.
